Design Sanctuary Workshop Terms And Conditions

I understand that by making a conference/workshop payment, I am committing to the selected workshop during the chosen time period. I also understand that due to high demand for this workshop,

Design Sanctuary Workshop does not offer full or partial refunds once payment is made. I have read and understand

Design Sanctuary Workshop Terms and Conditions as follows: 

BASIS OF SALE: We do our very best to accurately set expectations for each Design Sanctuary Workshop workshop on our website. Prior to purchase, it is each participant’s responsibility to carefully review the conference/workshop description. Scheduled activities are subject to change due to weather, presenter availability, construction and participant count. Participants will be informed should any schedule changes arise.

PAYMENT: Payment is collected electronically at time of purchase. Your purchase of the workshop is not secured until Design Sanctuary Workshop receives confirmation of payment from the credit card service. If you have signed up for a payment plan, Design Sanctuary Workshop will take the initial and secondary payments via the ticketing program at the time of registration and listed due date. Your registration is not considered secured until all agreed upon payments have been made. Due to the limited availability of conference space, at no time are the payments considered refundable. 

CREDIT AND REFUND POLICY: We understand that plans change and encourage our conference/workshop participants to think carefully about their purchase before committing to the conference/workshop. Design Sanctuary Workshop is not able to offer refunds for workshops after the date of purchase or credit for future workshops. Design Sanctuary Workshop may make exceptions to this policy in extenuating circumstances at Design Sanctuary Workshop's sole discretion. Workshops may be transferable from the purchaser to any other person for the scheduled workshop with written permission from Design Sanctuary Workshop prior to the conference/workshop. 

CANCELLATION POLICY: If Design Sanctuary Workshop must cancel a workshop for any reason,

Design Sanctuary Workshop will refund each participant the full amount of the deposit.

Design Sanctuary Workshop is not liable for travel, lodging, or other expenses associated with attending a workshop. While workshop cancellation is unlikely, we strongly encourage participants to purchase travel insurance to protect themselves.

Design Sanctuary Workshop reserves the right to decline conference/workshop admission to prospective participants.

Design Sanctuary Workshop also reserves the right to ask participants to leave the conference/workshop at any time its sole discretion. 

INDEMNIFICATION: 

Participants agrees to indemnify and hold harmless Design Sanctuary Workshop  against any and all liability, claims, suits, losses, costs and legal fees caused by, arising out of, or resulting from any negligent act or omission of Clients or acts of third parties. 


LIMITATION OF LIABILITY:

Design Sanctuary Workshop assumes no responsibility or liability in connection with services of any accommodations, proprietor or service, dining establishment, or travel service. While we make recommendations to our participants, each participant is solely responsible for their own experiences therein. While highly unlikely, Design Sanctuary Workshop 

reserves the right to change the dates or times of its conferences/workshops for any reason.  Design Sanctuary Workshop assumes no responsibility for third party damages, including loss of tickets, personal articles, or any additional expenses due to travel delays. Participants agree and understand that there are inherent risks involved with participating in the

Design Sanctuary Workshop workshops, including but not limited to: accidents involving transportation, weather related illness or injury, injuries from falling or tripping, participation of scheduled activities, injuries from use of floral tools and supplies, injury due to wild animals, allergies, and other risks. Participants are responsible for deciding their own comfort and wellness level and are under no obligation to participate in all activities. Participants agree that under no circumstances will

Design Sanctuary Workshop be liable to any participant for any direct or indirect damages including, but not limited lost profits, loss of use, loss of time, inconvenience, lost business opportunities, damage to good will or reputation and costs of cover, regardless of whether such liability is based on breach of contract, tort, strict liability or otherwise, and even if advised of the possibility of such damages or such damages could have been reasonable foreseen. Subject to the client’s obligation to pay the fees to Design Sanctuary Workshop each party’s entire aggregate liability for any claims relating to the services or this agreement shall not exceed the fees paid or payable by the client to

Design Sanctuary Workshop, under this agreement in the 12 month period immediately preceding the events giving rise to such liability. This section shall survive the termination of the agreement. No action shall be brought for any claim relating to or arising out of this agreement more than one (1) year after the accrual of such cause of action, except of money due on an open account. 

DISPUTE RESOLUTION:

Any dispute between Participants and Design Sanctuary Workshop arising under or in connection with this agreement shall be submitted to binding arbitration in Delaware County, Pennsylvania. Each party shall choose an arbitrator and those arbitrators, in turn, shall appoint a single arbitrator to hear the dispute. The arbitration shall be heard in accordance with the rules of the American Arbitration Association (AAA) and Pennsylvania law shall apply. The parties shall equally share the costs of arbitration.
